Mr. Sudhir Paruthi, Advocate for the caveator-respondent. ALKA SARIN, J. (ORAL) On 17.08.2021 the following order was passed : "After arguing for some time, counsel for the petitioners prays for time to seek instructions whether the petitioners-tenant are willing to file an affidavit/undertaking to vacate the shop within a reasonable period, in view of the concurrent findings whereby ejectment was ordered on account of the fact that the landlady is a widow, having 3 children and is litigating for her rights since 11.11.2014.

Accordingly, proceedings are deferred for the said purpose for 14.09.2021."

Thereafter the matter has been adjourned repeatedly on the request of learned counsel for the petitioners. On 15.12.2021 the following order was passed :

"The matter has been taken up through YOGESH SHARMA 2022.07.18 10:24 I attest to the accuracy and authenticity of this order/judgment.

Chandigarh

CR-1151-2021 (O&M) -2Videoconferencing on account of outbreak of pandemic COVID-19.

Learned counsel for the petitioner has made statement after dithering over a number of adjournments that the petitioner-tenant is not willing to make compliance of orders dated 17.8.2021.

Let the matter be listed for preliminary hearing on 3.2.2022."

Thereafter, again the matter was adjourned on the request of learned counsel for the petitioners. On the last date of hearing i.e. 22.03.2022, none had put in appearance on behalf of the petitioners. Today also the matter has been called twice but none has put in appearance on behalf of the petitioners. It appears that the petitioners are not interested in pursuing the present revision petition. This Court is left with no other option but to dismiss the present revision petition for non-prosecution. Dismissed for non-prosecution.
