Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in criminal complaint No.50 of 2015 dated 27.11.2015 titled as "Sunil vs. Brijesh Kumar Parashar" under Section 138 of the Negotiable Instruments Act and Section 420 IPC, pending in the Court of JMIC, Faridabad.

Notice of motion was issued. Learned counsel for the respondent appeared and contested the petition. I have heard learned counsel for the parties and have gone through the record.

The petitioner has already surrendered before the trial Court in compliance of the order dated 02.07.2018 and he has been released on VINEET GULATI 2018.08.16 14:52 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-26132 of 2018 -2interim bail. The offence under Section 138 of the Negotiable Instruments Act is a bailable offence. The petitioner is only to face the trial. No useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 02.07.2018 granting interim bail to the petitioner, is made absolute.
