*** RAMENDRA JAIN, J. (ORAL) Accused has preferred the present appeal along with an application for condonation of delay of 701 days, assailing judgment dated 13.02.2017 of the trial court, holding him guilty under Section 411 IPC and order of sentence dated 16.02.2017, sentencing him to undergo rigorous imprisonment for 3 years with fine of `2000/-. In default of payment of fine, to further undergo simple imprisonment for two months. The appellate court, in appeal, reduced the sentence of the appellant from 3 years to two years rigorous imprisonment. It would be worth noticing that Rehmat Ali-appellant approached this Court by way of CRR No.448 of 2019 (O&M), assailing the judgments of both the courts below, which was dismissed on 25.02.2019, recording his conviction as mentioned above. Now, concealing the factum of his partly accepted appeal filed SONIKA 2019.04.02 17:35 I attest to the accuracy and authenticity of this document Chandigarh by the appellant before first appellate court, thereby, reducing his sentence

CRA-S-901-2019 --2-- from 3 years to 2 years rigorous imprisonment and the factum of dismissal of his revision on 25.02.2019, the appellant has filed the instant appeal through Legal Services Authority, which amounts to cheating and committing fraud with this Court.

Dismissed.

Concerned CJM, Chandigarh is directed to take appropriate action against the appellant including registration of FIR, if required, after probing into his conduct afore-mentioned minutely. Registry is directed to send a copy of this order to concerned court.
