This order will dispose of two petitions, one filed by Palwinder Singh and Sukhpal Singh @ Sukha (CRM M 25239 of 2014) and the other filed by Baljit Singh and Dilbag Singh (CRM M 31584 of 2014). The FIR was registered at the instance of Avtar Singh complainant alleging that his brother Apar Singh was attacked by all the petitioners. So far as Palwinder Singh petitioner is concerned, he was attributed a lalkara. Sukhpal Singh petitioner has not been attributed any specific injury. Petitioner Baljit Singh has been attributed a dang blow on the left side of back, whereas petitioner Dilbag Singh is attributed a stick blow on the right eye brow. There are general allegations against all the petitioners that they had given leg blows while the deceased was lying on the ground.

Without going into the details of the medical and ocular version, it is sufficient to observe that petitioner Palwinder Singh has been attributed a lalkara, whereas no specific injury has been attributed to petitioner Sukhpal Singh @ Sukha. Cr. Misc. M 25239 of 2014 since 5.11.2013 whereas Sukhpal Singh @ Sukha has been in custody since 28.8.2013.

So far as petitioners Baljit Singh and Dilbag Singh ( petitioners in CRM M 31584 of 2014) are concerned, they have been attributed a dang and stick blow on the left side of back and on the right eye brow of deceased Apar Singh , respectively. They have been in custody since 28.8.2013. It is pertinent to observe here that the cause of death in the present case has been opined as myocardial infarction. In view of specific injuries having been attributed to Baljit Singh and Dilbag Singh, their petition (CRM M 31584 of 2014) is dismissed at this stage.

Taking into consideration the allegations against petitioners Palwinder Singh and Sukhpal Singh @ Sukha (petitioners in CRM M 25239 of 2014), they can be granted the concession of bail. Their petition (CRM M 25239 of 2014) is allowed and they are ordered to be released on bail on their furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
