The petitioner seeks grant of anticipatory bail in a case registered against him vide FIR No.55 dated 21.03.2021 at Police Station Dehlon, District Ludhiana, under Sections 61/78 of Punjab Excise Act.

At the time of issuance of notice of motion on 27.04.2021, the following order was passed:

"Learned counsel for the petitioner submits that the petitioner herein has been falsely implicated in the instant FIR. It is, inter-alia, argued that though the petitioner has been named in the FIR, but he was not present at the spot; nor he is the owner of the vehicle carrying the alleged contraband taken into possession. It is submitted that custodial interrogation of the petitioner would not be required as no recovery is to be effected from him and he is ready to join the investigation. Notice of motion.

CRM-M-17502-2021 (O&M) Mr. Bhupinder Beniwal, AAG, Punjab, who is present through the medium of video conferencing, accepts notice on behalf of the respondent-State and submits that the petitioner has been specifically named in the FIR and huge recovery of liquor has been recovered from the co-accused Jitender Singh. He seeks time to file reply.

Adjourned to 11.10.2021.

Meanwhile, the petitioner is directed to join the investigation within a period of one week and on his doing so, in the event of arrest the petitioner be released on interim bail to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall continue to join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C."

Learned State counsel upon instructions has informed that pursuant to interim directions issued by this Court, the petitioner has since joined investigation and his custodial interrogation is not required and that he is not wanted in any other case.

In view of the aforestated position, wherein the petitioner is stated to have joined investigation and his custodial interrogation is not required and is not even stated to be involved in any other case, the petition is accepted and the interim directions issued by this Court vide order dated 27.04.2021 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C. 27.10.2021 (GURVINDER SINGH GILL) VY JUDGE Whether speaking/reasoned: Yes/No Whether reportable:
