HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.09 dated 30.1.2022 under Section 15 of the NDPS Act (Sections 25/29 of the NDPS Act added later on) registered at P.S. Sadar Moga, District Moga. As per allegations in the FIR, a secret information was received that Sarbit Singh(petitioner) and Gurmeet Singh @ Yaku were engaged in the business of selling poppy husk by getting from other States. Secret information disclosed that Gurmeet Singh was sitting at the bus stand and waiting for customers. If a raid was conducted, he could be apprehended with a huge quantity of poppy husk. Acting on the said information, a raiding party was organized and Gurmeet Singh was apprehended.

It is alleged that during interrogation he disclosed that he along with the petitioner used to sell the poppy husk in different cities like Kurali, Ludhiana, Jagraon, Moga by getting the same from Rajasthan in a truck No.HP-64B-5713. He used to drive the truck with the petitioner being owner of the truck. On the disclosure statement of Gurmeet Singh, 50 bags of poppy husk each weighing 20 kgs were recovered from the first floor of house of Balwinder Singh @ Ghola, who is stated to be father-in-law of the MANOJ KUMAR 2022.04.

Learned counsel for the petitioner contends that neither the truck belongs to the petitioner nor has the recovery been effected from the premises in the ownership of the petitioner. The investigation is complete and the petitioner has been in custody since 03.02.2022 with other coaccused Gurmeet Singh being already in custody. Without commenting anything on the merits of the case and also bearing in mind the fact that the trial is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Sarabjit Singh @ Sarabjeet Singh is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. This present petition stands accepted accordingly.
