RAMENDRA JAIN, J. (ORAL) Through this petition under Section 482 Cr.P.C. prayer has been made for quashing complaint titled as "Roop Sachdeva v. M/s U.V. Silk Store and another" pending in the Court of learned Judicial Magistrate Ist Class, Ludhiana, and all consequential proceedings arising therefrom including summoning order dated 29.08.2016 (Annexure P-5).
Despite service, no one has appeared on behalf of the respondent.
Learned counsel for the petitioner inter alia contends that father of the petitioner, namely, Krishan Garg is the sole proprietor of M/s U.V. Silk Store, Bathinda. Petitioner has no concern with the said firm.
Having given thoughtful consideration to the submissions made by learned counsel for the petitioner, this petition merits RAVINDER SINGH 2018.09.20 09:46 I attest to the accuracy and authenticity of this document acceptance for the time being, unless proved otherwise that
-2CRM-M-26180 of 2018 petitioner had also any role or interest in the accused firm M/s U.V. Silk Store. Consequently, impugned order summoning the petitioner is set aside, directing the trial Court to proceed only against the father of the petitioner as sole proprietor of the aforesaid firm.
