Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.565 dated 26.05.2016 under Sections 148, 149, 323, 379-B, 452 and 506 IPC, registered at Police Station Chandni Bagh, Panipat.
Notice of motion.
On asking of the Court, Mr.Vikramjit Singh, Addl. Advocate General, Haryana, who is present in the Court, accepted notice on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. Police record is also available.
From the record, I find that the allegations against the present Vineet Gulati 2016.08.06 14:44 I attest to the accuracy and authenticity of this document Chandigarh petitioner and other co-accused are that they came to the house of Sunny at
CRM No.M-26108 of 2016 -212.30 a.m. at night time and knocked the door. When the door was opened, they trespassed into the house and assaulted Sunny and his two friends and while leaving, they took away `25,000/- and also snatched gold chain. The petitioner is in custody since 10.06.2016. He is not required for investigation or interrogation purposes. The injuries are stated to be simple in nature. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case.
Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
