Present:

Mr. Manav Bajaj, Advocate, for the appellants. Mr. Vipul Sharma, Advocate, for Mr. Paul S. Saini, Advocate, for respondent No.3-Insurance company.

****** As agreed, as per statements of the appellants, learned counsel and representative of the respondent-Insurance Company (separately recorded), a sum of Rs.5,65,000/- (Rupees Five Lakhs Sixty Five Thousands only) over and above the amount awarded by the Tribunal is allowed to the appellants in full and final settlement of the claim in this appeal. As per the statement of the learned counsel for the appellants, out of the total enhanced amount of Rs.5,65,000/-, a fixed sum of Rs.2,90,600/- shall be paid to appellant No.1-Shashi Bala (wife of deceased-Santosh Kumar Sharma) and the remaining amount of Rs.2,74,400/- shall be paid to appellants No.2 to 4 in equal shares.

Accordingly, we dispose of this case with the direction to the Insurance Company to deposit a crossed cheque for Rs.5,65,000/- i.e. a crossed cheque of Rs.2,90,600/- in the name of the appellant No.1-Shashi Bala and crossed cheque(s) of remaining amount of Rs.2,74,400/- in the name of appellants No.2 to 4 in equal shares with the Office of the Lok Adalat of the High Court, within four weeks from today, in compliance of this order, falling which, interest @ 9 % per annum shall follow on this amount till payment, from the date of this order. The concerned Officer of SUKHPREET KAUR 2022.08.25 04:02 I attest to the accuracy and integrity of this document the Lok Adalat Branch/Office shall issue a proper receipt after receiving the

cheque, to learned counsel/representative of the respondent-Insurance Company. The appellants' counsel/appellants may collect the cheque from the office of the Lok Adalat.

Copy of the order be supplied/sent to the counsel/parties and file be returned to the Hon'ble High Court.
