R.P. Nagrath, J. (Oral) After arguing for sometime, learned counsel for the petitioners seeks to withdraw the instant petition with liberty to raise all the contentions taken herein before the trial Court. Dismissed as withdrawn with liberty, as aforesaid. It is submitted that all the petitioners are already appearing before the trial Court. It is further submitted that petitioners no. 2 and 3 are old persons.

On moving appropriate application before the trial Court, the same shall be considered sympathetically and in accordance with law by the trial Court on petitioners No. 2 and 3 furnishing following undertakings:- 1.

that their advocate shall appear on their behalf on each and every date of hearing and the evidence recorded in their absence would be acceptable to them;

2.

that undertaking of their counsel to appear on each date of hearing to defend their case;

3.

that they will not dispute their identity and they will appear before the trial Court as and when directed by the Court.
