**** MANJARI NEHRU KAUL , J. (Oral) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No. 30, dated 17.03.2020, under Section 395 IPC, registered at Police Station Daresi, District Ludhiana.
Learned counsel appearing on behalf of the petitioner has failed to satisfy this Court qua any material change in circumstances subsequent to the withdrawal of the previous petition filed under Section 439 Cr.P.C. on 14th January, 2021. Further, on a pointed query put to learned counsel, it was submitted that the petitioner has been in the custody for about 01 year 02 months. The custody period cannot be taken to be a material change in circumstances, which would warrant entertaining instant petition. Learned State counsel has filed the custody certificate of the petitioner in Court today through e-mail. Same is taken on record, subject to all just exceptions. CRM-M-17873-2021 - 2 - Learned State counsel while inviting the attention of this Court to the custody certificate and also on instructions from ASI Amrik Singh, has submitted that the petitioner is a man of criminal antecedents and he is involved in an another criminal case registered under Sections 457, 380 IPC.
Heard.
Prima facie, there are serious and specific allegations levelled against the petitioner, for which he does not deserve the concession of bail. Petition stands dismissed.
