R.P. Nagrath, J. (Oral) Petitioner seeks bail under Section 439 Cr.P.C. in FIR No. 4 dated 02.01.2014 for offences under Sections 398 and 401 of Indian Penal Code (IPC) and Section 25 of Arms Act, registered at Police Station Dharuhera, District Rewari. The version of prosecution in FIR is that on 02.01.2014, certain miscreants came in Scorpio car and tried to rob police officials of their vehicle. They were intercepted. Those miscreants fired on the police officials but no one injured in the occurrence. Scorpio car was, however, left at the spot by the miscreants. Learned State counsel on instructions from ASI Rajinder Singh submits that petitioner was arrested in Rajasthan in FIR No. 98 dated 16.02.2014 for offences under Section 323, 341, 342 and 395 IPC, Police Station Kishangarh Baas, District Alwar. Learned counsel for the petitioner contended that version of prosecution on the identity of the culprits is seriously in doubt. The petitioner is in custody since 30.06.2014 and it will take long time in conclusion of the trial. The challan has already been presented. In view of the above and without commenting on the merits of the case, the instant petition is allowed and the petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
