**** RAJ MOHAN SINGH, J. (Oral) Petitioner seeks grant of anticipatory bail in case bearing FIR No.88 dated 05.03.2020 registered under Section 420 IPC at Police Station Division No.5, District Ludhiana. On 21.04.2022, following order was passed by this Court:- "Learned counsel for the petitioner contends that CRM-M No. 24356 of 2021 was got dismissed as withdrawn with a liberty to file fresh petition with better particulars after arrival of the petitioner from Australia. Learned counsel for the petitioner further submits that necessary interim protection could not be sought in the earlier petition. Petitioner is still ready and

willing to come to India despite all odds against his medical condition, but in the absence of interim protection there would be no point in filing anticipatory bail. Learned counsel also submits that the petitioner is also ready and willing to pay the entire money along with interest.

Notice of motion for 17.05.2022.

In the peculiar facts and circumstances of the case, let there be an interim protection in favour of the petitioner till the next date of hearing.

In the meanwhile, the petitioner may come to India and join the investigation by the next date of hearing. In the event of his joining investigation after appearance before the Investigating Officer, the petitioner shall be released on interim bail subject to the satisfaction of the Arresting Officer, however, the petitioner shall abide by the conditions as envisaged under Section 438(2) Cr.P.C."

Learned counsel for the petitioner submits that in compliance of the aforesaid order, the petitioner has come to India and joined the investigation to the entire satisfaction of the Investigating Officer.

This fact has been admitted by learned State counsel on instructions from ASI Sukhpal Singh.

In view of above, the interim order dated 21.04.2022 is made absolute. However, petitioner shall keep on joining the investigation as and when required to do so and shall abide by

the conditions as envisaged under Section 438(2) Cr.P.C. Petition stands disposed of.
