RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to the petitioner in case FIR No.59 dated 22.04.2012 under Section 21 of the NDPS Act (Sections 420/465/468/471 IPC added lateron) registered at Police Station Canal Colony, Bathinda. Learned counsel for the petitioner contends that initially the petitioner, on bail was regularly attending the Court on each and every date, but he absented on 27.07.2016 on account of his illness. Consequently, his bail bonds and surety bonds were cancelled and forfeited to the State and he was declared proclaimed offender. On coming to know this fact, petitioner surrendered before the trial Court on 02.05.2017 and since then he is in custody.

In view of the totality of the facts and circumstances of the case that the petitioner is facing trial for having possession of 7 grams of smack, which falls within the definition of "non-commercial quantity" and further Ravinder Singh 2017.07.21 18:54 I attest to the accuracy and authenticity of this document that he himself had surrendered before the trial Court, the petitioner is

-2CRM-M-25271 of 2017 admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of trial Court/CJM, Bathinda.

Accordingly, the petition is allowed.
