Learned counsel contends that as per allegations of the prosecution, 14 bottles, each containing 100 ml of Rexcof, were recovered from the petitioner on 16.06.2010; on 27.07.2010 the petitioner was granted interim bail by the Judge, Special Court, Ludhiana, and after receipt of the report from Forensic Science Laboratory, the petitioner was once again arrested on 13.07.2015 and since then he is behind the bars.
Keeping in view totality of the facts and circumstances of the case, the present petition is allowed. The petitioner, Baljit Singh @ Bhundi, son of Rikhi Singh, resident of Jassowal, Police Station, Sudhar, District Ludhiana, is directed to be released on bail during pendency of the trial of the present case subject to his furnishing bonds to the satisfaction of learned Trial Court.
