Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 213 dated 23.11.2014 under Section 307, 323, 341, 506, 120-B, 148, 149 of the Indian Penal Code, 1860, registered at Police Station Sultanpur, District Kapurthala. As per the prosecution case, on 22.11.2014, injured Gaganjot Singh was attacked by the petitioner and his co-accused. Harvinderpal Singh was armed with a datar whereas Surinderpal Singh was armed with an iron rod, Resav was armed with an iron rod and Harjeet Singh @ Kakku was armed with a datar. It is also the case of the prosecution that the said accused were accompanied by 3-4 unknown persons.

Learned counsel for the petitioner has submitted that petitioner is in custody since 24.11.2014. Challan has already GURPREET SINGH 2015.09.30 10:22 I attest to the accuracy and authenticity of this document

Crl. Misc. No. M-25229 of 2015 -2been presented in the Court and conclusion of trial may take time. Learned State counsel, who is assisted by the counsel for the complainant, on the other hand, has opposed the petition. Keeping in view the fact that petitioner is in custody since 24.11.2014 and the fact that the case is now listed before the Trial Court for prosecution evidence, it would be just and expedient to order the release of the petitioner on bail. Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Kapurthala.
