Learned counsel contends that the petitioners were entitled for promotion commensurate with their qualifications and for pay parity with Surinder Kumar.

Learned State counsel submits by making a reference to the preliminary submissions of the written statement dated 19.12.2005, wherein it has been specifically stated that the aforesaid person was absorbed on 07.05.1997 after having been retrenched from Industry Department, Punjab and his appointment was made as per his qualifications on the higher post in compliance to the order of this Court, whereas the petitioners having been appointed on lower posts of Clerks and were promoted as Inspector Grade-II on the basis of their seniority and merit in that cadre in terms of 3rd option exercised by them as per the Departmental Service Rules and then all the promotional posts thereupon. As such they could not have been granted any parity, to which there is no rebuttal by filing replication nor learned counsel during the course of arguments was able to substantiate the basis of their claim. 3.

In view of the above, there being no merit in the petition, the same is dismissed.
