This petition has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in case FIR No.335 dated 25.5.2018 registered for the offences under Sections 323, 365, 342 and 34 IPC and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015 at Police Station Sadar Bhiwani, District Bhiwani.
Notice of motion has been issued in this case. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

No.M-26301 of 2018 [2] From the record, I find that as per the allegations in the FIR Pankaj was called by Banti and then he along with Deepak went in the car along with the present petitioner to the fields and then as per the allegations simple injuries with blunt weapon had been given and then he came back to the house of present petitioner.
Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find that the present petitioner is not required for any custodial interrogation purposes and nothing is to be recovered from him. Therefore, I accept this criminal miscellaneous petition and in the event of arrest, the petitioner shall be admitted to bail on his furnishing personal bonds and surety to the satisfaction of the Arresting/ Investigating Officer. The petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
