Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.22 dated 28.02.2018 under Section 457 and 380 IPC, registered at Police Station Navi Baradari, District Jalandhar.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that in the present case, FIR has been got registered by Diva Jaitley. As per her version, her husband called a rickshaw puller, who parked his rickshaw in the kothi. The complainant along with rickshaw puller went to Guru Nanak Mission Hospital. After some time, rickshaw puller stated that he had to go. The complainant's husband went along with him. CRM No.M-26319 of 2018 -2party came to their house, they saw that gate of the house was already lying opened and internal wooden was found to be broken etc. Three mobile phones were found to be stolen. The rickshaw puller was apprehended and he nominated the present petitioner.

Keeping in view the facts and circumstances of the present case and in view of the fact that one mobile has been recovered and still other recoveries are to be made, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. The petitioner is required for custodial interrogation.

Therefore, finding no merit in the present petition, the same is dismissed.

However, nothing stated above, shall constitute my opinion on merits of the case.
