ARUN MONGA, J. (ORAL) Petitioners herein, inter alia, seek issuance of a writ in the nature of mandamus directing the respondents to consider their candidature in final selection list and issue appointment letters by awarding 05 additional marks to them.

Vide an advertisement dated 07.09.2019 (Annexure P-1), the petitioners applied for the post of Staff Nurse under Scheduled Caste Category. They successfully cleared the written examination conducted by the respondent-department and were called for counseling/scrutiny of documents, which was conducted on 22.11.2021/23.11.2021. Grievance of the petitioners is that at the time of declaration of result, they were not awarded additional five marks for the denotified category. Qua the aforesaid grievance, the petitioners submitted a representation dated 16.04.2022 (Annexure P-5), but to no avail. Hence, the instant petition. 3.

Learned State counsel, on advance service, joins proceedings and states that competent authority shall take appropriate decision on the pending representation dated 16.04.2022 (Annexure P-5). GURPREET KAUR 2022.04.22 19:04 I attest to the accuracy and integrity of this document

At this stage, learned counsel for the petitioner also agrees that let a final decision is taken, either way, by the competent authority on the pending representation dated 16.04.2022 (Annexure P-5), giving reasons thereof.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner as per representation dated 16.04.2022 (Annexure P-5) and keeping in view the contention raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law.

Let the needful be done as expeditiously as possible. 8.

Disposed of accordingly.
