(Oral) This petition qua petitioner no. 2-Pardeep Sharma @ Sunny has already been dismissed as infructuous vide order dated 3.8.2015 as he has already been arrested.
The allegations against petitioner-Neeraj Kumar are that on 21.6.2015, he along with his co-accused non-applicants have tress-passed into house of complainant Prem Kumar and caused him simple injuries. The State counsel assisted by Mr. SS Kainth, counsel for the complainant submitted that three injuries on the person of the complainant are by blunt means are simple in nature.

Criminal Misc. No. M-25342 of 2015 -2Keeping in view the same and that sending the petitioner to custody would not sub-serve any purpose, the instant petition is allowed. In the event of arrest, petitioner no. 1-Neeraj Kumar shall be released on bail to the satisfaction of arresting/investigating officer till submission of report under Section 173 Cr.P.C. (challan). Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court. The petitioner shall, however, join the investigation as and when called for and shall also abide by the conditions specified under section 438 (2) Cr.P.C. Presently the petitioner is directed to join the investigation within 10 days.
