(Oral) This is the first petition filed under Section 438 Cr.P.C for grant of anticipatory bail to the petitioner in criminal case No.NACT-7094 of 2017 dated 23.10.2017 titled as "Sachida Nand Singh v. Ram Palat" under Section 138 of Negotiable Instruments Act, 1881 pending in the Court of ld. JMIC, Jalandhar.

Learned counsel for the petitioner seeks to withdraw the present petition with liberty to file a fresh petition under Section 482 Cr.P.C for challenging the PO order and by placing on record all the relevant zimni orders.

In view of the above, the present petition is dismissed as withdrawn with the afore-said liberty.

In case, the second petition is filed, the same would be heard independently on merits.
