The petitioner is seeking regular bail in case FIR No. 330 dated 17.12.2019, registered under Sections 379-A and 379-B IPC, Police Station City, Faridkot.

The allegations in the FIR are that two persons on Activa snatched mobile phone from the complainant. During investigation Prabhjot Singh (non-applicant) was arrested and on his disclosure statement, the petitioner too was later arrested.

Learned counsel for the petitioner submits that neither the petitioner has been named in the FIR nor any role has been attributed to him. No recovery has been effected from him. Moreover, he has been implicated in the case on the basis of disclosure statement of co-accused, which has no evidentiary value. Learned counsel for the petitioner further submits that there is no previous history of any kind of offence having been committed SONU 2020.06.11 10:51 I attest to the accuracy and integrity of this document by the petitioner and he is in custody for more than 5 months. Trial is not

likely to conclude soon due to situation arising out of current Covid-19 Pandemic.

On the other hand, learned State counsel has opposed the prayer. He submits that investigation is complete and challan has already been filed.

The petitioner is in custody for about five months. No other case is pending against him. Investigation of the case is already over and his custodial interrogation is no more required. The trial is not likely to conclude soon. Without expressing any opinion on the merits of the case, the petition is allowed. The petitioner is ordered to be released on regular bail subject to his furnishing bonds to the satisfaction of Chief Judicial Magistrate/ Duty Magistrate Faridkot.
