 has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No.7 dated 05.02.2016, registered at Police Station Sadar Rampura, District Bathinda, under Sections 364, 34 of Indian Penal Code, Sections 302, 201, 109, 120-B of Indian Penal Code added later on vide DDR No.14 dated 13.02.2016.

Notice of motion was issued. Mr. K.S.Aulakh, DAG, Punjab has put in appearance on behalf of the respondent-State and Mr. Naveen Sharma, Advocate has put in appearance on behalf of the complainant and contested this petition.

I have heard learned counsel for the parties as well as learned Rajesh Kumar 2017.10.11 16:50 I attest to the accuracy and authenticity of this document Chandigarh State counsel and gone through the record.


 
 

 
 From the record, I find that the FIR in the instant case was registered on the basis of statement made by complainant-Rajinder Singh to the effect that Gurpreet Singh alias Tidda along with his brother-in-law Ganga Singh kidnapped Gurvinder Singh nephew of the complainant. It is in the FIR that Gurpreet Singh alias Tidda has doubt over his nephew Gurvinder Singh having illicit relations with his wife. Later on, dead body of Gurvinder Singh was recovered and accordingly Section 302 of Indian Penal Code was added.

The petitioner is the main accused and the material witnesses are yet to be examined.

Therefore, keeping in view the facts and circumstances of the present case, nature and gravity of the offence, I do not find it a fit case where the petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the instant petition, the same is dismissed.
