The present petition has been filed by Ranjit Singh son of Buta Singh for grant of anticipatory bail in FIR No.52 dated 05.05.2020 under Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, 1956 registered at Police Station City Rampura, District Bathinda. In a nutshell, FIR was registered on the basis of secret information received that the petitioner and his mother Paramjit Kaur, were running a brothel from their residence and had kept 2-3 girls, who were available during both times, day and night regularly on payment of money to Paramjit Kaur. On raiding the house, Paramjit Kaur, some girls and customers were arrested, who were later released on regular bail. However, the petitioner is alleged to have escaped from the spot. Counsel for the petitioner has argued that the petitioner has no role to play nor are there any specific allegations regarding his participation in the alleged offence, that he is neither the owner of the house, where the SAVITA KADIAN 2020.06.01 16:38 I attest to the accuracy and integrity of this document High Court Chandigarh

CRM-M-13209 of 2020 {2} alleged offence was being committed nor was he present on the spot when raid was conducted. He claims to be working as a Conductor in the Truck Union.

Submissions made by the counsel have been considered. Specific allegation has been levelled against the petitioner that he and his mother were running a prostitution racket from their home. These allegations are of a very serious nature. Custodial interrogation of the petitioner is necessary for making proper investigation of the case. Prostitution is eroding the moral fabric of the society. No relief can be granted to a person who is alleged to be instrumental in commission of immoral acts.

Petition is dismissed. However, it is clarified that the petitioner will deposit the requisite Court fee, file the 'Power of Attorney' and his attested affidavit in original within a period of one week after the lockdown is over.
