Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.96 dated 06.05.2016 under Sections 452, 307 and 34 IPC, registered at Police Station Sector-26, Chandigarh. Notice of motion.

On asking of the Court, Mr.Gautum Dutt, Addl. Public Prosecutor, Chandigarh, who is present in the Court, accepted notice on behalf of the respondent-U.T. Chandigarh and contested the petition. I have heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor and have gone through the record. Police record is also available.

From the record, I find that FIR in the present case has been got registered by Hukam Chand. As per the prosecution version, Parmod @ Vineet Gulati 2016.08.06 14:44 I attest to the accuracy and authenticity of this document Chandigarh Ohada present petitioner was stated to be armed with danda and gave

CRM No.M-26317 of 2016 -2injuries along with other co-accused. Shiva @ Chhotu non-applicant was stated to be armed with an object which look like a knife. The injuries are stated to be inflicted on left hand.

The petitioner is in custody since 06.05.2016. He is not required for investigation or interrogation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `30,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
