(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.14 dated 01.02.2019, registered under Sections 406 and 420 IPC (later on added Punjab Double Professional Regulation Act, 2014), Police Station Bassi Pathana, District Fatehgarh Sahib (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise.
Pursuant to order dated 29.03.2019 of this Court, the parties appeared before the trial Court on 18.04.2019 along with receipts of `15,000/- to get their statements recorded. Learned Chief Judicial Magistrate, Fatehgarh Sahib, has submitted his report vide letter bearing No.436 dated 23.04.2019 duly forwarded by learned District and Sessions SONIKA 2019.05.24 09:46 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-14499 of 2019 --2-- Judge, Fatehgarh Sahib, vide letter bearing No.2723/EB dated 24.04.2019. According to the report, ld. Chief Judicial Magistrate, Fatehgarh Sahib, is satisfied that genuine and valid compromise has been effected between the parties which is without any pressure or undue influence of any manner upon either of the parties. No accused has been declared as proclaimed offender.
Considering the report of ld. Chief Judicial Magistrate, Fatehgarh Sahib, dated 23.04.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.14 dated 01.02.2019 along with all subsequent proceedings arising therefrom, is quashed qua the petitioner only. Disposed of accordingly.
