NIDHI GUPTA, J. (ORAL) After remaining unsuccessful before both the Courts below, the plaintiff/appellant-Gram Panchayat, has filed the instant Regular Second Appeal, against the judgment and decree of Ist Appellate Court dated 25.10.1996, affirming the judgment and decree of the trial Court dated 20.07.1995, whereby the 'suit for declaration' filed by the plaintiff/appellant to the effect that plaintiff is owner in possession of the land as described in the head note of the plaint was dismissed. At the outset, learned counsel for the appellant-Gram Panchayat, informs that the present appeal has been rendered infructuous and may be disposed of, as such as, the defendant-respondents have already sold the entire suit land and are no longer residing in the village. In view of the foregoing circumstances, nothing survives in the present appeal and the same is disposed of as having been rendered infructuous.
