Petitioner has instituted third petition seeking regular bail in case FIR No.0499 dated 22.10.2018 under Sections 302,120-B IPC and Sections 25,54,59 of Arms Act (Sections 212,34 IPC added later on) registered at P.S Butana, District Karnal.
A perusal of file reveals that the petitioner had earlier filed CRM-M53274 of 2021 praying for grant of regular bail, which was dismissed by this Court on 08.04.2022 on merits.
Learned counsel for the petitioner states that the trial is being unnecessarily delayed and in the last one year, no prosecution witness has been examined. The petitioner has been in custody since 23.10.2018 i.e about four and half years.
Per contra, learned State counsel submits that out of 25 prosecution witnesses, fourteen have already been examined and eleven remain to be examined. Next date fixed before the trial Court for recording evidence of prosecution witnesses is 18.05.2023.
Taking note of the facts of the present case and without commenting anything on the merits of the case, this petition is disposed of with a request to learned trial Court to endeavour to dispose of the case at the earliest, preferably within a period of six months.
