Present petition under Section 482 Cr.P.C. for quashing of order dated 14.12.2018 (Annexure P5), passed by the learned Judicial Magistrate Ist Class, Barnala, District Barnala, whereby petitioner was declared proclaimed offender in case FIR No. 63 dated 12.06.2018, registered under Sections 399, 402 & 307 IPC and Section 25 of the Arms Act, 1959.

Learned counsel for the petitioner contended that the petitioner is ready to surrender before the learned trial Court and file an application for admitting him to bail.

On asking of the Court, Mr. Pawan Sharda, Senior Deputy Advocate General, Punjab accepts notice on behalf of respondent. A complete copy of paper-book be provided to him during the course of the day.

Criminal Misc. No. M-13677 of 2019 In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to bail, the learned trial Judge shall decide the same within a period of one week thereafter. However, petitioner shall be at liberty to raise all the pleas before the learned trial Judge which have been raised in the present petition.
