This order will dispose of the above mentioned two criminal miscellaneous petitions filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in case FIR No.49 dated 20.5.2011 registered for the offences under Sections 420, 466, 468 and 471 IPC at Police Station Chatiwind, Amritsar Rural, District Amritsar, as these arise HARPAL SINGH PARMAR 2015.10.06 17:24 I attest to the accuracy and authenticity of this document Chandigarh

Both the petitioners have been summoned under Section 319 Cr.P.C. by the trial Court. They are not required for investigation or interrogation purposes nor anything is to be recovered from them as the trial is already going on and they are simply to face the trial in the Courrt. In view of the interim orders passed in both these petitions, the petitioners have already appeared before the trial Court. Learned State counsel states that the petitioners have been released on interim bail. The trial of the case will take long time. No purpose will be served by sending them into custody. Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in these petitions and the same are allowed. The interim order dated 5.8.2015 passed in Criminal Misc. No.M-25434 of 2015 and interim order dated 28.8.2015 passed in Criminal Misc. No.M-28681 of 2015 by this Court granting interim relief to the petitioners are made absolute.
