Mr.Sukhmeet Singh, Advocate for the petitioner. **** RAJ MOHAN SINGH, J. (Oral) Petitioner has preferred this petition for issuance of an appropriate writ, especially in the nature of mandamus, directing the respondents to release his two buses, which have been impounded by the respondents.

Learned counsel for the petitioner submits that on 28.11.2020, his buses were running in the State according to permit and the same were stopped at Kalinwali by respondent No.2 and were challaned for want of high security number plates and without paying the due tax.

Grievance of the petitioner is that respondent No.2 has issued challan for Rs.50,500/- for not paying the due tax and not installing the high security number plates, but the petitioner had already paid the taxes towards both the buses vide receipts dated 03.11.2020 and 11.11.2020 i.e. Annexures P-5 and P-6. Respectively.

CWP No.8116 of 2022 Petitioner has also moved an application before respondent No.1 on 10.03.2021 for cancellation of aforesaid challans in respect of both the vehicles. Respondent No.1, vide letter dated 10.03.2021 directed respondent No.2 to take necessary action in the matter within a period of seven days from the receipt of letter dated 10.03.2021, but till date no action has been taken by respondent No.2.

Keeping in view the facts and circumstances of the case as projected by learned counsel for the petitioner and without meaning anything on the merits of the case, this petition is disposed of with a direction to respondent No.2 to consider the letter dated 10.03.2021 issued by respondent No.1 strictly in accordance with law, preferably within a period of two weeks from the receipt of certified copy of this order.
