(Oral) Learned counsel for the petitioner has placed on record affidavit of complainant Harbhajan Singh to vouch for the compromise settlement that has been arrived at between the complainant Harbhajan Singh and accused-petitioner Raj Kumar @ Rinku. Heard.

The allegations against petitioner Raj Kumar @ Rinku in this anticipatory bail application are that during December, 2012 and January, 2013, petitioner along with his co-accused non-applicants had duped the complainant for a sum of Rs 12 lacs on the pretext of enabling him to get recruitment in the Indian Railways as Ticket Collector and subsequently, it transpired that the complainant has been duped leading to the registration of the present FIR.

Criminal Misc. No. M-25459 of 2015 (O&M) -2Learned counsel for the petitioner submits that a compromise has been effected between the present petitioner Raj Kumar and complainant Harbhajan Singh whereby the complainant has received Rs 4 lacs that has come to the share of the petitioner and the counsel for the complainant has supported the contention of the counsel for the petitioner to this effect and learned State counsel has not even opposed the bail application.

In the event of arrest, the petitioner shall be released on bail to the satisfaction of arresting/investigating officer till submission of report under Section 173 Cr.P.C. (challan). Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court. The petitioner shall, however, join the investigation as and when called for and shall also abide by the conditions specified under section 438 (2) Cr.P.C. The present petition stands disposed off.
