Mr. Rajan Bansal, Advocate for the applicant-respondent no.1 ******* ALKA SARIN, J. (Oral) The present review application has been filed by a counsel who was neither the filing counsel nor the arguing counsel at the time of hearing and disposal of the main revision petition.

Learned counsel for the applicant-respondent no.1 relies upon the judgment of this Court in the case of Des Raj alias Deso vs. Financial Commissioner, Taxation, Punjab & Ors. [2003(3) RCR (Civil) 493] to contend that the review application at the behest of a new counsel is maintainable. It is further the contention of learned counsel for the applicantrespondent no.1 that there is a new legal point which is involved in the present case.

Learned counsel by way of the present review application seeks to re-argue the matter, which is beyond the scope of review. The judgment relied upon by learned counsel for the applicant-respondent no.1 is also of no avail to him inasmuch as in the said case the ground of review was that there was an apparent mistake in the earlier order which had necessitated the filing of the review application and hence it was held that such a review JITENDER KUMAR 2022.08.09 11:15 I attest to the accuracy and authenticity of this order/judgment Chandigarh

application cannot be dismissed being not maintainable. In the present case, there is no error apparent on the face of the record. However, an endeavour has been made to re-argue the matter, on a new point, which is not permissible in law.

In view of the fact that the present review application has been filed by a new counsel as well as the fact that no ground whatsoever is made out for review of the order dated 17.03.2022 passed in CR No.5585 of 2017, the present review application is accordingly dismissed.
