This application has been filed by the petitioner-wife with a prayer to transfer the proceedings of the petition under Section 9 of the Hindu Marriage Act, 1955, bearing No. HMA/112/2021 titled as "Monu Sharma v. Labh Kaur", presently pending before the Principal Judge, Family Court (Camp Court at Ghula), District Kaithal, Haryana, to the Court of competent jurisdiction at District Mansa, Punjab. 2.
It is not in dispute that the petitioner is presently residing at Mansa along with her five years old child and the respondent is also defending the proceedings under Section 125 Cr.P.C. at Mansa. 3.
Keeping in view the aforesaid facts, the present application is allowed. The proceedings of case "Monu Sharma v. Transfer Application No. 503 of 2021 (O&M) transferred to the Court of competent jurisdiction at District Mansa, Punjab. The transferor Court is requested to remit the file of the aforesaid case to the transferee Court forthwith. The parties, through their learned counsel, are directed to appear before the Court of District and Sessions Judge at Mansa on 03.11.2021, who shall either try the case himself or assign it to any other Presiding Judge having jurisdiction.
