*** Sudhir Mittal, J. (Oral) The petitioner is a College of Nursing which was established in the year 2011. No objection certificate was issued in the same year and the petitioner was permitted to admit 60 students in the GNM Course. Thereafter, the petitioner was also registered with the State Nursing Council and was imparting education to 60 students. Vide communication dated 28.10.2014, the Indian Nursing Council reduced the number of seats to 30 unilaterally. The judicial decisions have come into being which say that the Indian Nursing Council has no jurisdiction in the matter of number of seats and that only the State Nursing Council has the jurisdiction. Thus, representation dated 10.03.2022 (Annexure P-14) was filed for increase in the annual intake in accordance with the No Objection Certificate. The said representation has not been decided till date and, thus, writ petition has been filed for a direction to the concerned respondents to decide the same by passing a speaking order.
