The present appeal pertains to the year 1996. Vide order dated 22.11.2023 notices were issued to the appellant and respondent Nos.2 to 4, 6 to 9. As per the service report, sole appellant remains unserved with the report that he was not found residing at the given address. There is no other address available with the Court for effecting service of the appellant except the one mentioned in the memo of parties and in the judgments and decrees passed by the Trial Court and the First Appellate Court and is the same on which the notice was sent. None has put in appearance on behalf of respondent No.1. Respondent Nos.2 to 4, 6, 7 and 9 also remain unserved with the report that they were not found residing at the given addresses. Respondent No.5 already proceeded against ex parte vide order dated 12.09.1996.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
