**** ANITA CHAUDHRY, J(ORAL) The petitioner is seeking regular bail in FIR No. 786 dated 17.12.2015 registered at Police Station City Bhiwani, District Bhiwani under Sections 346 IPC and Sections 363, 366, 376-D, 120-B IPC and Section 6 of POCSO Act were added later on.

Counsel for the petitioner contends that the victim was missing from the house since December 2015 and was recovered almost a month later and a missing report was lodged by the father who did not suspect anyone. On recovery the victim had made a statement that her father used to beat her and the petitioner used to live in the colony and she had been instigating her against her father and had assured that she would get married in a good house and she had left her at Bhiwani Bus Stand and had asked her to go to Hansi.

Copy of the statement of the girl recorded under Section 164 Cr.P.C. has been placed on record. The only role given to the petitioner is Gurpreet Singh Bhatia 2016.08.10 11:04 I attest to the accuracy and authenticity of this document High Court Chandigarh

Crl. Misc. No. M-26439 of 2016 -2that she had left her at Bhiwani Bus Stand. There are no specific accusation that the petitioner had accompanied her or had played any further role. The prosecutrix has been examined. The question of tampering would not arise. Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on her furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
