Petitioner has filed this petition under Section 482 Cr.P.C. against respondents State of Punjab and Gurpreet Singh for quashing the FIR No.162 dated 16.07.2016 under Section 382 IPC registered at Police Station Kotwali, District Bathinda along with all the subsequent proceedings arising therefrom on the basis of compromise. Notice of motion was issued. Learned State counsel appeared. However, none appeared on behalf of respondent No.2, despite service. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As respondent No.2 is not appearing in the Court, therefore, no direction can be given to the trial Court to record the statements of the parties.

Therefore, present petition stands dismissed. However, the petitioner is at liberty to file the petition afresh, if respondent No.2 agrees to the compromise and ready to appear in the Court.
