Present petition under Section 438 Cr.P.C. seeking pre-arrest bail to the petitioner in case FIR No. 358 dated 06.11.2017, registered under Sections 22 & 29 of the Narcotic Drugs & Psychotropic Substances Act, 1985 and Section 52A of the Prison Act, 1894 at Police Station City Sangrur, District Sangrur.

Learned counsel for the petitioner contended that petitioner was earlier admitted to bail by the learned trial Judge and petitioner had been regularly appearing before the learned trial Court. However, on the date fixed i.e. 11.02.2019, petitioner could not appear before the learned trial Court because of death of his daughter and the learned trial Judge cancelled his bail and issued non-bailable warrants of arrest against him. More so, petitioner is ready to surrender before the learned trial Court and furnish fresh bail bonds to the satisfaction of the learned trial Judge. Notice of motion.

Criminal Misc. No. M- 13601 of 2019 On asking of the Court, Mr. Rajesh Bansal, Assistant Advocate General, Punjab accepts notice on behalf of respondent. A complete copy of paper-book be provided to him during the course of the day. In view of the facts detailed in the present petition, the same is allowed and impugned order dated 11.02.2019 stands set aside. In case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for releasing him on bail, the learned trial Judge shall admit him on bail on his furnishing fresh bail bonds and surety bonds.
