The petitioners have filed this petition under Section 482 Cr.P.C. against State of U.T., Chandigarh and other respondents for issuance of direction to respondents No.2 and 3 to protect the life and liberty of the petitioners from the hands of respondents No.4 to 11. I have heard learned counsel for the petitioner and have gone through the record.
I have gone through the representation given by the petitioners dated 13.07.2017. The perusal of the representation shows that private respondents have got registered an FIR against Rajan Sharma son of the petitioner, under Sections 363-A and 366 IPC at Police Station Mani Majra, Chandigarh. It is also stated that accused persons with hand in gloves with each other, got registered the false case. The Investigating Officer used to call them to the Police Station and made them to sit all the day and Vineet Gulati 2017.07.26 10:04 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-25601 of 2017 -2threatened to involve them in the above-mentioned FIR. It is further stated in the representation that the private respondents are very influential persons and they in hand with gloves with the SHO, Mani Majra, are bent upon to falsely implicate them in some false case.
The perusal of the representation nowhere shows that private respondents No.4 to 11 have ever given any threat to the life and liberty of the present petitioner. There is nothing in the representation that any attempt was even made to give injuries to the petitioners. Rather, the case of the petitioners in the representation is that FIR has been registered against son of the petitioner and they are apprehending that they may be implicated in a false case.
From the perusal of the record, I find that there is no serious threat to the life and liberty of the petitioners and no ground is made out for providing security to the petitioners.
Therefore, finding no merit in the present petition, the same is dismissed.
