Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.46 dated 28.02.2016 under Sections 323/325/354/354B/ 506/148/149 IPC registered at Police Station Sultanwind, District Amritsar City. Contentions on behalf of the petitioners as noted on 19.07.2017 by this Court, read as under:- "It is contended that no specific role has been attributed to the petitioner. Co-accused Balwinder Singh alias Billa has been afforded the concession of anticipatory bail by this Court vide order dated 24th April, 2017 in Criminal Miscellaneous No.M-37537 of Omkar Singh 2017.11.03 10:16 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-25619 of 2017 -22016. It is specifically stated by learned counsel that none of the petitioners are proclaimed offenders and neither any such proceedings are pending against them."

It is submitted that the petitioners have joined investigation pursuant to interim order dated 10.08.2017 passed by this Court. They undertake to face trial and not misuse the concession of bail if afforded to them. Therefore, it is prayed that this petition be allowed.

Learned counsel for the State informs that the petitioners have joined investigation. Their custodial interrogation is not required. No recovery is to be effected from them. There are no allegations on behalf of the State that the petitioners are likely to abscond or that they are likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Keeping in view the facts and circumstances as above but without commenting upon or expressing any opinion on the merits of the case, this petition is allowed. Consequently, order dated 10.08.2017 is made absolute. It is clarified that none of the observations made hereinabove shall be construed to be a reflection on the merits of the case. The same are solely confined for the purpose of decision of the present petition. ( LISA GILL ) November 1 , 2017.
