       When confronted with the decision rendered by the Supreme Court in Midnapore People's Cooperative Bank Ltd. and others vs. Chunni Lal Nanda and others 2006 (5) SCC 399, wherein it has been held that Letters Patent Appeal against an interim order is not maintainable, learned counsel for the appellant prays for and is permitted to withdraw the appeal with liberty to move an appropriate application in the pending matter before the learned Single Judge. As prayed, the appeal is dismissed as withdrawn with the liberty aforesaid.
