Seeking setting aside of order dated 17.01.2026 passed by JMIC, Bahadurgarh whereby the respondents were discharged, the petitioner has come up before this Court by filing the present revision petition.

On a query from this Court about the maintainability of present petition before this Court, counsel for the petitioner submits that there are concurrent jurisdictions and this Court has revisional jurisdiction. If the contention of counsel for the petitioner is taken in toto, in that case, petitioner may forfeit his right to second agitation by coming to this Court but petitioner has no right to encroach the rights of the respondents to review their order from the High Court, as such in these circumstances, the appropriate Court is the Sessions Court. Instead of exercising such remedy, the petitioner has come up before this Court.

Faced with the situation, counsel for the petitioner wishes to withdraw the present revision petition with liberty to file fresh before the Sessions Court. Ordered accordingly. The time for which the present revision petition was pending before this Court shall not be counted for the purpose of limitation. All pending applications, if any, stand disposed of.
