Learned counsel for petitioner submits that the petitioner was earlier found innocent and got discharged from custody vide order dated 7.10.2014. The trial court vide order dated 3.5.2017 has again summoned him to face trial for offence punishable under Section 21 of Narcotic Drugs & Psychotropic Substances Act. The petitioner is ready to surrender before the trial court and to face trial.
In view of the submissions of learned counsel for petitioner and keeping in view the fact that earlier he was declared innocent and got discharged, this petition is allowed and the petitioner is directed to surrender before the trial court within two weeks from today. On his appearance before the trial court, he shall be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate subject to the conditions that may be imposed by it.
