The present appeal pertains to the year 1997. Vide order dated 14.12.2023 notices were issued to the appellants as well as respondent Nos.1 to 5, 7 to 9 and 11. As per the service report, appellant Nos.1, 3 and 4 were not found residing at the given address. Appellant Nos.2, 8 and 9 were not present at the time of service. Appellant Nos.5 and 6 are stated to have died. Appellant No.7 stands duly served. There is no other address of appellant Nos.1, 3 and 4 available with the Court for effecting service of them except the one mentioned in the memo of parties and in the judgments and decrees passed by the Trial Court and the First Appellate Court and is the same on which the notice was sent. Neither anybody has appeared on behalf of the appellant No.

7 nor anyone has put in appearance on behalf of the legal representatives of the appellant Nos.5 and 6. Respondents No.1, 4, 6, 7, 10 and 11 have also died. Respondent Nos.2 and 9 stand duly served. Respondent Nos.3 and 5 were not found residing at the given address. In Ankur Goyal 2024.05.

RSA-1421-1997 (O&M) --2-- view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
