Prayer in the present petition filed under Article 226 of the Constitution of India is for issuance of a writ in the nature of habeas corpus directing respondents No.3 to 5 to release the detenue Sukhwinder Kaur wife of Ricky, Vansh son of Ricky and Gurjit Singh son of Nachattar Singh. On 06.03.2026, this Court was pleased to pass the following order:- "In compliance with the order dated 06.03.2026 passed by Hon'ble Ms. Justice Rupinderjit Chahal, undersigned was appointed as Warrant Officer in the above noted case on 06.03.2026.

At the very outset learned counsel for the petitioner told undersigned that petitioner will meet me at Rupnagar. I left Chandigarh at 6.30 pm on 06.03.2026. Petitioner along with her associate met me near bus stand Rupnagar and asked me to

conduct search at CIA Rupnagar. We reached CIA Rupnagar at 8.00 pm on 06.03.2026. I/In-charge CIA, Mandeep Singh was present there. After disclosing my identity and purpose of visit, I along with associate of petitioner searched each and every corner of CIA Rupnagar but detenues-Sukhwinder Kaur, Vansh and Gurjit Singh were not found present there. Petitioner also called detenues by name but there was no response. Statement of In-charge CIA, Rupnagar may kindly be perused at Annexure R-1.

Thereafter, we came out of CIA, Rupnagar. Petitioner asked me to conduct search in police station Sadar Rupnagar. We reached there at 9.40 pm. Duty Officer SI Dharam Pal was present there. After disclosing my identity and purpose of visit, I along with associate of petitioner searched each and every corner of police station Sadar, Rupnagar but detenuesSukhwinder Kaur, Vansh and Gurjit Singh were not found present there. Petitioner also called detenues by name but there was no response.

In the meantime, I/SHO Sunny Khanna also reached there. He furnished statement (Annexure R-2) to the effect that FIR No. 27 dated 02.03.2026 u/s 103(1) BNS 25/27-54-59 Arms Act, police station Sadar Rupnagar (Annexure R-3) had been registered against unknown persons. On 03.03.2026, Gurbhej son of Darshan Singh had identified the body of his deceased brother Ali Mohd. resident of Chhuhar Majra and on the basis of his statement Ricky and Vicky had been nominated as accused and raids are being conducted for their arrest. He further stated that Sukhwinder Kaur (wife of Ricky) and Gurjit Singh (father of Ricky and Vicky) had neither been called in the police station nor they are required in any case at this stage. Thereafter, we came out of police station Sadar Rupnagar. Petitioner asked me to conduct search in police post Purthali. We reached there at 10.55 pm. Police Post Incharge ASI Boota Singh was present there. After disclosing my identity

and purpose of visit, I along with associate of petitioner searched each and every corner of police post Purthali but detenues-Sukhwinder Kaur, Vansh and Gurjit Singh were not found present there. Petitioner also called detenues by name but there was no response.

In-charge, Police post Purthali furnished statement (Annexure R-4) to the effect that detenues had neither been called in the police post nor they are required in any case. Petitioner furnished statement (Annexure R-5) to the effect that she does not want to search detenues at any other place as she does know any other place to search them. GD entry made by the concerned police stations is at Annexure R-6 to R-8.

I left for Chandigarh at 11.30 pm on 06.03.2026." 2.

As per aforesaid report, submitted by the Warrant Officer, the detenues were not found at the places as told by the petitioner. Further the petitioner furnished statement to the Warrant Officer to the effect that she does not want to search detenues at any other place as she does not know any other place to search them.

In view of the report submitted by the Warrant Officer, the instant petition has become infructuous and is disposed as such.
