The petitioner has been in custody w.e.f. 7.10.2015 in a case registered on 10.10.2011 at the instance of Sajjan Kumar pertaining to an incident of 8.10.2011 when the complainant and other persons were attacked by the petitioner and his accomplice, constituting an unlawful assembly. The petitioner had been granted the concession of regular bail but he absented on 3.6.2014 and was declared a proclaimed offender on 10.11.2014. During the period of custody of the petitioner w.e.f. 7.10.2015 no prosecution witness has been examined. Even otherwise, the petitioner has not been attributed any grievous injury on the person of the complainant or other injured persons. The period of detention, suffered by the petitioner, will certainly have deterrent effect upon him, preventing him from evading appearance before the trial court. The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
