(ORAL) This is a petition that has been filed for grant of anticipatory bail to the petitioner in case FIR No.100 dated 22.05.2017 under Sections 363 & 366 IPC, registered at Police Station Phase-I Mohali. This Court was pleased to pass the following order on 19.07.2017 :- "Heard.

It is contended that the allegations, as made in the FIR, are not sustainable on account of the fact that the petitioner and Ms. Heba got married on 19.05.2017 prior in time to the lodging of the FIR. Ms. Heba is present in Court and submits that she is happily residing with the petitioner.

Notice of motion for 06.12.2017.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C."

CRM-M-25703-2017 -2Learned counsel for the petitioner submits that the petitioner and the complainant solemnized a marriage on 19.05.2017 and since then she has been residing happily in her matrimonial home. Learned counsel for the respondent-State, on instructions from HC Raj Kumar, submits that the petitioner has joined investigation and in fact the parties are residing happily together. Since the petitioner has joined the investigation and the fact that the parties are residing happily together, the petition is allowed and interim order dated 19.07.2017 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C. 06.12.2017 (JAISHREE THAKUR) Satyawan JUDGE Whether speaking/reasoned Yes.
