Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.115 dated 19.04.2018 under Sections 22 and 29 of the NDPS Act, registered at Police Station City Sangrur.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per the allegations against the present petitioner, he is son of one Karamjit Singh @ Pammi, who has been lodged in District Jail, Sangrur in case under Section 302 IPC. CRM No.M-26657 of 2018 -2jail to hand-over desi ghee to Karamjit Singh @ Pammi. When the police officer asked for search of present petitioner, he got perplexed and after throwing the article, ran away. From the desi ghee, 290 intoxicating tablets were found containing salt of Buprenorphine Hydrochloride 1.92 mg/tablet. The petitioner tried to smuggle intoxicating tablets in the jail and he is named in the FIR.
Keeping in view the serious allegations against the petitioner and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find that petitioner is required for custodial interrogation and no ground is made out for grant of benefit of anticipatory bail to the petitioner. Therefore, finding no merit in the present petition, the same is dismissed.
